After more than 6 years of implementing Decree 15/2018/ND-CP, a number of issues have arisen that need to be considered for amendment and supplementation to suit the practical requirements of food safety management in the context of administrative procedure reform as well as strengthening post-inspection management measures to improve food quality, specifically:
1. Administrative procedure reform:
- English documents are exempt from notarized translation if they have been consularly legalized.
- Accept electronic copies of legal documents.
- Allow the use of test results of GMP-compliant production facilities.
- Limit the number of times and the time limit for supplementing product declaration documents.
- Simplify procedures for importing charitable aid foods.
- Remove some documents from the health supplements/ dietary supplements food advertising registration dossier.
- Abolish the requirement for GMP certificates for domestically produced health supplements/ dietary supplements foods.
- Develop unified management software from central to local levels.
2. Strengthen decentralization and delegation of authority:
- Decentralize the issuance of Certificate of Free Sale for exported foods.
3. Strengthen post-control:
- Strictly control organizations and individuals declaring products.
- Add product formula explanation section to control quality.
- Require re-declaration when changing important elements of the product.
- Strengthen product quality control after declaration.
4. Implement the recommendations of the Government Inspectorate:
- Require a report on the effectiveness of functional foods introduced to the market for the first time.
- Amend regulations on scientific evidence in the declaration documents.
5. Other proposals:
- More clearly define functional foods and health supplements/ dietary supplements foods.
- Stricter regulations on self-declaration procedures for products.
- Amend regulations on the management of alcohol product groups.
